What happens when they get sick? Are they eligible for paid sick leave, or are they entitled to make a claim for workers\u2019 compensation?<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n\n<h2><span style=\"font-size: 20pt; font-family: Arial; color: #000000;\">Sick Leave as First Line of Defense<\/span><\/h2>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">If you offer paid sick days to your employees, and the individual(s) in question have unused time, sick leave is likely the best avenue for both you and the employee.<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">That\u2019s because they already have this time, which they\u2019re entitled to, and you\u2019ve already set money aside for it. It gives the employee easy access to their earned paid time off. Offering the paid time off helps to ensure they\u2019ll follow the advice of local authorities and quarantine if they happen to test positive.<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">Some employers may consider making their<\/span> <a href=\"https:\/\/thepayrolledge.com\/fr-ca\/blog\/taking-time-off-to-care-for-family-members-difference-between-canada-and-the-us\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 12pt; font-family: Arial; color: #1155cc; text-decoration: underline;\">sick leave policies<\/span><\/a><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\"> more flexible, to extend to more situations. This could include allowing employees to use their sick days to care for a relative or if they need to quarantine due to someone in their household becoming ill. Other employers will want employees to use this time only if the employee themselves is sick.<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n\n<h2><span style=\"font-size: 20pt; font-family: Arial; color: #000000;\">Federal and State Mandated Leaves<\/span><\/h2>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">Employers will also want to ensure they have updated their policies to be in line with revisions laid out in state and local legislation. Many of these changes are directed at sick leaves and caregiving arrangements. You could be required by law to provide off.<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">These laws exist at both the federal and state level, so what you\u2019re required to do<\/span><a href=\"https:\/\/www.dol.gov\/newsroom\/releases\/whd\/whd20200401\" target=\"_blank\" rel=\"noopener\"> <span style=\"font-size: 12pt; font-family: Arial; color: #1155cc; text-decoration: underline;\">may change<\/span><\/a><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\"> by state of operation.<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n\n<h2><span style=\"font-size: 20pt; font-family: Arial; color: #000000;\">What about Workers\u2019 Compensation?<\/span><\/h2>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">Some experts have pointed out that depending on the circumstances, an employee becoming ill in the workplace, in the course and scope of their regular duties, could be a workers\u2019 compensation issue.<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">The argument centers around the possibility that the employee may have been exposed to a heightened risk during the course and scope of their duties. If the employee becomes ill, this could count as an \u201coccupational illness.\u201d<\/span><\/p>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">In such instances, employees may wish to file workers\u2019 compensation claims, if they\u2019re eligible for workers\u2019 compensation benefits in your area.<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">They can also use any available sick leave. However, if an employee doesn\u2019t have access to sick leave of some sort, then a workers\u2019 compensation claim may be the only way for them to replace lost wages, though each state has mandatory \u201cwaiting periods\u201d for lost wage benefits.<\/span><\/p>\n<p style=\"line-height: 1.5;\"><\/p>\n\n<h2><span style=\"font-size: 20pt; font-family: Arial; color: #000000;\">Does Sick Leave Cancel out Workers\u2019 Compensation?<\/span><\/h2>\n<p style=\"line-height: 1.5;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\">If an employee takes sick leave, they may still pursue a<\/span> <a href=\"https:\/\/thepayrolledge.com\/fr-ca\/blog\/the-complexities-of-workers-compensation-in-canada\/\" rel=\" noopener\"><span style=\"font-size: 12pt; font-family: Arial; color: #1155cc; text-decoration: underline;\">workers\u2019 compensation<\/span><\/a><span style=\"font-size: 12pt; font-family: Arial; color: #000000;\"> claim.
