Votre obligation sp\u00e9cifique de d\u00e9p\u00f4t d\u00e9pend enti\u00e8rement de celle de votre travailleur   <\/span><b>statut de r\u00e9sidence<\/b> <span style=\"font-weight: 400;\">fiscale.<\/span>\n\n<span style=\"font-weight: 400;\">Voici un aper\u00e7u des formulaires essentiels que vous devez conna\u00eetre, r\u00e9partis en deux principaux domaines de conformit\u00e9 pour les entreprises internationales :<\/span>\n<h2><b>Section 1 : Formulaires pour les travailleurs bas\u00e9s aux \u00c9tats-Unis (r\u00e9sidents et citoyens)<\/b><\/h2>\n<span style=\"font-weight: 400;\">Ces formulaires s\u2019appliquent lorsque vous embauchez un citoyen am\u00e9ricain ou un <\/span><b>\u00e9tranger r\u00e9sident<\/b><span style=\"font-weight: 400;\"> (une personne qui remplit le crit\u00e8re de pr\u00e9sence substantielle de l\u2019IRS ou qui d\u00e9tient une carte verte).\n\n<\/span>\n<h3><b>1. Formulaire W-4 : Permet de retenir les imp\u00f4ts<\/b><\/h3>\n<span style=\"font-weight: 400;\">Le premier formulaire que vous devrez remplir par un employ\u00e9 est un <\/span><a href=\"https:\/\/www.google.com\/url?q=https:\/\/www.irs.gov\/forms-instructions&amp;sa=D&amp;source=docs&amp;ust=1765176635840629&amp;usg=AOvVaw3LoC_5z7tgX0pXo7q4rROw\"><b>formulaire W-4<\/b><span style=\"font-weight: 400;\"> (<\/span><b>Certificat de retenue \u00e0 la source de l\u2019employ\u00e9<\/b><\/a><span style=\"font-weight: 400;\">). Formulaire I-9 : V\u00e9rification de l\u2019admissibilit\u00e9 \u00e0 l\u2019emploi<\/b><\/h3>\n<span style=\"font-weight: 400;\">Toutes les personnes que vous engagez pour vos op\u00e9rations commerciales aux \u00c9tats-Unis devraient \u00eatre l\u00e9galement autoris\u00e9es \u00e0 travailler. C\u2019est pourquoi ils doivent remplir   <\/span><a href=\"https:\/\/www.uscis.gov\/i-9\"><b>Formulaire I-9<\/b><\/a><b>, V\u00e9rification de l\u2019admissibilit\u00e9 \u00e0 l\u2019emploi<\/b><span style=\"font-weight: 400;\">. Si un employ\u00e9 refuse de remplir et de d\u00e9poser un formulaire I-9, il se peut qu\u2019il ne soit pas admissible au travail.<\/span>\n\n<span style=\"font-weight: 400;\">Embaucher des travailleurs qui ne sont pas admissibles \u00e0 travailler aux \u00c9tats-Unis peut avoir des r\u00e9percussions sur votre entreprise. Vous pourriez \u00eatre p\u00e9nalis\u00e9 par l\u2019IRS ou m\u00eame soumis \u00e0 des visites d\u2019agents d\u2019immigration. Cela peut aussi perturber la retenue d\u2019imp\u00f4t et la paie, car les employ\u00e9s non admissibles \u00e0 l\u2019emploi peuvent aussi ne pas remplir le formulaire W-4 mentionn\u00e9 ci-dessus.  \n\n<\/span>\n<h3><b>3. Formulaire W-2 : Doit \u00eatre d\u00e9pos\u00e9 pour l\u2019imp\u00f4t sur le revenu<\/b><\/h3>\n<span style=\"font-weight: 400;\">En tant qu\u2019employeur, vous devrez aussi remplir et remettre <\/span><b>le formulaire W-2<\/b><span style=\"font-weight: 400;\"> (<\/span><b>d\u00e9claration de salaire et d\u2019imp\u00f4t<\/b><span style=\"font-weight: 400;\">) chaque ann\u00e9e fiscale. Si vous payez un employ\u00e9 plus que   <\/span><b>600 $ US<\/b><span style=\"font-weight: 400;\">  dans un an, vous devez remplir ce formulaire et le d\u00e9poser aupr\u00e8s de l\u2019IRS. Une copie de votre dossier doit \u00e9galement \u00eatre envoy\u00e9e \u00e0 l\u2019employ\u00e9 pour obtenir ses dossiers. L\u00e9galement, vous devez envoyer les W-2 avant la fin janvier de chaque ann\u00e9e pour l\u2019ann\u00e9e pr\u00e9c\u00e9dente.  \n\n<\/span>\n<h3><b>4. Formulaire 1099 : est destin\u00e9 aux entrepreneurs<\/b><\/h3>\n<span style=\"font-weight: 400;\">Il peut arriver que vous embauchiez des travailleurs qui ne correspondent pas tout \u00e0 fait au profil d&rsquo;\u00ab employ\u00e9s \u00bb. Ces gens-l\u00e0 sont des contractuels, et vous devrez d\u00e9poser une plainte   <\/span><b>Formulaire 1099<\/b><span style=\"font-weight: 400;\"> (<\/span><b>Revenu divers<\/b><span style=\"font-weight: 400;\"> ou <\/span><b>r\u00e9mun\u00e9ration non employ\u00e9e<\/b><span style=\"font-weight: 400;\">).<\/span>\n\n<span style=\"font-weight: 400;\">Les entrepreneurs collaborent avec vous dans un dossier interentreprises, donc vous n\u2019avez pas \u00e0 leur retenir l\u2019imp\u00f4t sur le revenu. Ils n\u2019ont pas besoin de remplir le formulaire W-4. Vous devrez vous assurer que l\u2019employ\u00e9 obtient un num\u00e9ro d\u2019assurance sociale avant de pouvoir avancer avec le reste des formulaires. \n\n<\/span>\n<h2><b>Section 2 : Formulaires internationaux essentiels pour les travailleurs non r\u00e9sidents<\/b><\/h2>\n<span style=\"font-weight: 400;\">Ces formulaires constituent le v\u00e9ritable objectif de <\/span><b>la conformit\u00e9 fiscale internationale des employeurs<\/b><span style=\"font-weight: 400;\">, puisqu\u2019ils dictent les r\u00e8gles de retenue \u00e0 la source et de d\u00e9claration pour les paiements effectu\u00e9s \u00e0 des entit\u00e9s ou individus non r\u00e9sidents.\n\n<\/span>\n<h3><b>6. Formulaire W-8BEN : Certification du statut \u00e9tranger<\/b><\/h3>\n<span style=\"font-weight: 400;\">C\u2019est sans doute le formulaire le plus important pour une personne non r\u00e9sidente (par exemple, un contractuel ou un employ\u00e9 travaillant \u00e0 l\u2019ext\u00e9rieur des \u00c9tats-Unis et qui se qualifie comme <\/span><b>\u00e9tranger non-r\u00e9sident ou<\/b> <span style=\"font-weight: 400;\">NRA).<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Obligation de l\u2019employeur :<\/b><span style=\"font-weight: 400;\"> L\u2019employeur\/payeur doit <\/span><b>percevoir<\/b><span style=\"font-weight: 400;\"> le formulaire W-8BEN aupr\u00e8s de la personne non r\u00e9sidente pour confirmer son statut \u00e9tranger et pour r\u00e9clamer toute prestation en vertu d\u2019une <\/span><b>convention fiscale<\/b><span style=\"font-weight: 400;\"> (qui peut r\u00e9duire le taux de retenue l\u00e9gale de 30% sur le revenu d\u2019origine am\u00e9ricaine \u00e0 0%).<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Cons\u00e9quence du non-respect :<\/b><span style=\"font-weight: 400;\"> Sans un W-8BEN rempli, l\u2019employeur est l\u00e9galement tenu de retenir l\u2019imp\u00f4t au taux l\u00e9gal complet de 30%.\n\n<\/span><\/li>\n<\/ul>\n<h3><b>7. Formulaire 1042-S : Revenu de source am\u00e9ricaine d\u2019une personne \u00e9trang\u00e8re soumis \u00e0 la retenue \u00e0 la source<\/b><\/h3>\n<span style=\"font-weight: 400;\">Ce formulaire est le bulletin annuel de d\u00e9claration qu\u2019un employeur utilise <\/span><b>en remplacement du<\/b><span style=\"font-weight: 400;\"> formulaire W-2 ou 1099 pour les travailleurs non r\u00e9sidents.<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Obligation de l\u2019employeur :<\/b><span style=\"font-weight: 400;\"> L\u2019employeur\/payeur <\/span><b>d\u00e9pose<\/b><span style=\"font-weight: 400;\"> ce formulaire annuellement pour d\u00e9clarer les revenus vers\u00e9s \u00e0 la NRA ainsi que tout imp\u00f4t retenu (si applicable).<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Distinction cl\u00e9 :<\/b><span style=\"font-weight: 400;\">  Le 1042-S couvre divers types de revenus, y compris les salaires exempt\u00e9s de retenue \u00e0 la source en vertu d\u2019une convention fiscale. L\u2019employeur utilise le sp\u00e9cifique   <\/span><b>Code du revenu<\/b><span style=\"font-weight: 400;\"> sur le formulaire 1042-S pour sp\u00e9cifier le type de revenu d\u00e9clar\u00e9.\n\n<\/span><\/li>\n<\/ul>\n<h3><b>8. Formulaire 1042 : D\u00e9claration annuelle de retenue \u00e0 la source<\/b><\/h3>\n<span style=\"font-weight: 400;\">Il s\u2019agit du <\/span><b>formulaire principal de rapprochement<\/b> de l\u2019employeur <span style=\"font-weight: 400;\"> pour toutes les activit\u00e9s fiscales des non-r\u00e9sidents pour l\u2019ann\u00e9e.<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Obligation de l\u2019employeur :<\/b><span style=\"font-weight: 400;\"> L\u2019employeur d\u00e9pose chaque ann\u00e9e le formulaire 1042 aupr\u00e8s de l\u2019IRS pour r\u00e9sumer le montant total du revenu de source am\u00e9ricaine vers\u00e9 \u00e0 tous les non-r\u00e9sidents ainsi que l\u2019imp\u00f4t total retenu et d\u00e9pos\u00e9 au cours de l\u2019ann\u00e9e (tel que d\u00e9clar\u00e9 sur tous les formulaires 1042-S).\n\n<\/span><\/li>\n<\/ul>\n<h3><b>9. Formulaire NR4 (ARC) : D\u00e9claration des montants pay\u00e9s ou cr\u00e9dit\u00e9s aux non-r\u00e9sidents du Canada<\/b><\/h3>\n<span style=\"font-weight: 400;\">Puisque la conformit\u00e9 canadienne est un \u00e9l\u00e9ment cl\u00e9 du paysage concurrentiel, les employeurs internationaux doivent conna\u00eetre les r\u00e8gles de l\u2019Agence du revenu du Canada (ARC).<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Obligation de l\u2019employeur :<\/b><span style=\"font-weight: 400;\">  Le NR4 est l\u2019\u00e9quivalent canadien du US 1042-S. Le payeur doit   <\/span><b>Remplissez<\/b><span style=\"font-weight: 400;\"> ce formulaire pour d\u00e9clarer les montants vers\u00e9s \u00e0 un non-r\u00e9sident du Canada qui sont assujettis \u00e0 l\u2019imp\u00f4t <\/span><b>de la partie XIII<\/b><span style=\"font-weight: 400;\"> (une retenue \u00e0 la source canadienne, habituellement 25%).<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Conventions fiscales :<\/b><span style=\"font-weight: 400;\"> Comme pour l\u2019IRS, l\u2019employeur doit percevoir les <\/span><b>formulaires de la s\u00e9rie NR300<\/b><span style=\"font-weight: 400;\"> (NR301, NR302, NR303) aupr\u00e8s du non-r\u00e9sident afin de soutenir l\u2019application d\u2019un taux de retenue r\u00e9duit en vertu d\u2019une convention fiscale.<\/span><\/li>\n<\/ul>\n<h3><b>10. Conformit\u00e9 aux services au Canada (R\u00e8glement 105)<\/b><\/h3>\n<span style=\"font-weight: 400;\">Les employeurs qui paient des entrepreneurs non-r\u00e9sidents pour le travail effectu\u00e9 au Canada ont une obligation particuli\u00e8re.<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Obligation de l\u2019employeur :<\/b><span style=\"font-weight: 400;\"> Le payeur doit retenir <\/span><b>15%<\/b><span style=\"font-weight: 400;\">  des paiements bruts effectu\u00e9s \u00e0 un non-r\u00e9sident pour les services rendus au Canada.
