Ce guide compare les deux, offrant une image plus claire de vos obligations envers vos employ\u00e9s, peu importe o\u00f9 ils travaillent. <\/p>\n<h2>Allocations pour aidants aux \u00c9tats-Unis<\/h2>\n<p>Au niveau f\u00e9d\u00e9ral, la Loi sur<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fmla\" target=\"_blank\" rel=\"noopener\"> le cong\u00e9 familial et m\u00e9dical (FMLA)<\/a> pr\u00e9voit jusqu\u2019\u00e0 12 semaines de cong\u00e9 prot\u00e9g\u00e9 pour l\u2019emploi aux employ\u00e9s admissibles. En vertu de la loi, les employ\u00e9s qui prennent ce cong\u00e9 non pay\u00e9 conserveront l\u2019acc\u00e8s \u00e0 leurs prestations, \u00e0 condition qu\u2019ils effectuent des paiements de primes applicables et aient le droit de retourner au m\u00eame emploi. Si ce poste n\u2019existe plus, il se peut qu\u2019il faille lui offrir un poste \u00e9quivalent.  <\/p>\n<p>La FMLA ne couvre pas tout le monde, cependant. La loi f\u00e9d\u00e9rale s\u2019applique aux entreprises comptant 50 employ\u00e9s ou plus et peut s\u2019appliquer aux relations avec des employeurs conjoints. <\/p>\n<p>Les employ\u00e9s sont admissibles s\u2019ils travaillent pour un employeur couvert et ont accumul\u00e9 un minimum de 1 250 heures sur une p\u00e9riode de 12 mois. Les 1 250 heures n\u2019incluent pas les cong\u00e9s pay\u00e9s pour vacances ou cong\u00e9s de maladie.  <\/p>\n<p>Les employ\u00e9s peuvent b\u00e9n\u00e9ficier de la FMLA pour leurs propres conditions de sant\u00e9 graves ou chroniques, pour fournir des soins \u00e0 un membre de leur famille malade ou pour certaines exigences du service militaire.<\/p>\n<p>\u00c9tant donn\u00e9 que la FMLA est un avantage non r\u00e9mun\u00e9r\u00e9, certains \u00c9tats ont introduit des cong\u00e9s de soins pay\u00e9s. Ces lois permettent aux employ\u00e9s de prendre cong\u00e9 pour s\u2019occuper des membres de leur famille. La principale diff\u00e9rence avec la FMLA, c\u2019est que ces cong\u00e9s sont pay\u00e9s.  <\/p>\n<p>Les cong\u00e9s de soignant sous-pay\u00e9s, l\u2019employ\u00e9 per\u00e7oit g\u00e9n\u00e9ralement un pourcentage de son salaire pendant son absence. Certains \u00c9tats ont des lois sur la table, qui ne sont pas encore en vigueur. Si votre entreprise fonctionne dans un \u00c9tat sans cong\u00e9 pay\u00e9, les employeurs peuvent choisir de payer les employ\u00e9s qui prennent un cong\u00e9 FMLA. Ils peuvent aussi utiliser des cong\u00e9s pay\u00e9s, comme les jours de maladie ou les vacances, pour couvrir tout ou partie d\u2019un cong\u00e9 FMLA non pay\u00e9.    Si vous choisissez de payer pour des cong\u00e9s, les employeurs doivent s\u2019assurer d\u2019\u00eatre coh\u00e9rents dans leurs pratiques.  <\/p>\n<p>Au d\u00e9but d\u2019avril, le gouvernement f\u00e9d\u00e9ral a introduit une mesure temporaire visant \u00e0 rendre un cong\u00e9 pay\u00e9 disponible pour les travailleurs am\u00e9ricains touch\u00e9s par la COVID-19, la Families First Coronavirus Response Act (FFCRA). Le programme offre des cr\u00e9dits d\u2019imp\u00f4t \u00e0 certains employeurs qui offrent des cong\u00e9s pay\u00e9s FFCRA pour maladie ou cong\u00e9 familial \u00e0 leurs employ\u00e9s. <\/p>\n<h2>Cong\u00e9 d\u2019urgence pour les employ\u00e9s canadiens<\/h2>\n<p>Les dispositions concernant les cong\u00e9s de soins pour les travailleurs canadiens varient aussi d\u2019une province \u00e0 l\u2019autre. En Ontario, par exemple, les travailleurs ont droit \u00e0 jusqu\u2019\u00e0 10 jours de cong\u00e9 d\u2019urgence non pay\u00e9 pour des raisons sp\u00e9cifiques. <\/p>\n<p>\u00c0 la lumi\u00e8re de la COVID-19, le gouvernement de l\u2019Ontario a instaur\u00e9 un cong\u00e9 non pay\u00e9 pour les travailleurs touch\u00e9s de presque toutes les fa\u00e7ons. Le cong\u00e9 d\u2019urgence a \u00e9t\u00e9 \u00e9tendu aux travailleurs ayant besoin de cong\u00e9 pour s\u2019occuper de leurs enfants, qui sont tomb\u00e9s malades de la COVID-19 ou qui doivent s\u2019occuper de quelqu\u2019un. <\/p>\n<p>Au niveau f\u00e9d\u00e9ral, certains de ces travailleurs peuvent acc\u00e9der \u00e0 la<a href=\"https:\/\/www.canada.ca\/en\/services\/benefits\/ei\/cerb-application.html\" target=\"_blank\" rel=\"noopener\"> Prestation canadienne d\u2019intervention d\u2019urgence<\/a>, qui offre des paiements pendant la p\u00e9riode o\u00f9 le travailleur est incapable d\u2019exercer ses fonctions.<\/p>\n<p>D\u2019autres provinces ont introduit des mesures diff\u00e9rentes. Le gouvernement f\u00e9d\u00e9ral et les provinces ont \u00e9galement introduit une multitude d\u2019avantages con\u00e7us pour aider les entreprises \u00e0 maintenir leurs membres d\u2019\u00e9quipe sur la paie, tout en all\u00e9geant la pression caus\u00e9e par la r\u00e9cession. <\/p>\n<p>\u00c0 bien des \u00e9gards, les prestations de cong\u00e9 d\u2019urgence canadiennes ressemblent \u00e0 celles des \u00c9tats-Unis.
